Commonly Asked Questions about Idaho Rental Laws

Overall, they can charge any amount of rent they consider appropriate since the state of Idaho doesnt impose any rent control laws. Its important to note that landlords in Idaho can increase rent as much as they want. However, theyre required to send a 15-day notice to the tenant before they do it.
Limits on Rent Increases Unlike some other states, Idaho does not impose any limits on how much a landlord can raise the rent. Landlords have the right to increase rents to match current market rates when a lease term ends or during a month-to-month tenancy, as long as proper notice is given.
Landlords cannot raise rent more than 10% total or 5% plus the percentage change in the cost of living whichever is lower over a 12-month period. If the tenants of a unit move out and new tenants move in, the landlord may establish the initial rent to charge. (Civ. Code 1947.12.)
If the tenant doesnt move out of the rental within the three days, the landlord can file an eviction lawsuit. (Idaho Code 6-303(4) (2024).)
Idahos status as a moderately landlord-friendly state reflects a balance between the interests of landlords and tenants. First, there are no maximums on security deposits or late fees, allowing landlords flexibility in managing their properties and addressing damages or delays in rent payment.
Idaho Renters Rights Right to Safety and Health. Idaho Code 6-320 establishes certain duties that a landlord has in relation to the condition of the property. Right to Quiet Use and Enjoyment. Right to No Discrimination in Housing. Right to Possession. Right to the Return of Your Security Deposit.
Late Fees: There is no statutory limit on late fees in Idaho. Grace Period: There is no mandatory grace period in Idaho. NSF/Bounced Check Fee Maximum: If the tenants rent check bounces, the landlord may charge 12% interest and a fee of $20 or the face amount of the check, whichever is lesser.
