Who Must File \u2014 Who Must Pay. The Unincorporated Business Tax (UBT) is imposed on any individual or unincorporated entity that is carrying on or currently liquidating a trade, business, profession, or occupation within New York City.
For taxable years beginning on or after January 1, 1997, a partnership engaged in an unincorporated business is required to file an Unincorpo- rated Business Tax return if its unincorporated business gross income is more than $25,000 or it has unincorporated business taxable income of more than $15,000.
This declaration form provides a means of paying Unincorporated Business Tax on a current basis for individuals, estates and trusts engaged in carrying on an unincorporated business or profession, as defined in Section 11-502 of the Administrative Code. Partnerships use Form NYC-5UB for filing their declarations.
The Form IT-204-IP provided to you by your partnership lists your distributive share of any credits, credit components, credit factors, recapture of credits, and any other information reported by the partnership during the tax year. You need this information when completing your individual income tax return.
