The IHT217 is specifically used on estates where the first deceased spouse left everything to their partner who survived them, there can be no legacies to other family members or friends otherwise the amount left in legacies will be taken away from their nil rate band.
You must complete the form IHT400, as part of the probate or confirmation process if theres Inheritance Tax to pay, or the deceaseds estate does not qualify as an excepted estate.
If there is tax to pay, or if the affairs of the deceased do not meet certain conditions, you will have to provide a formal account of the estate by filling in form IHT400 and sending it to us. Where the deceased died abroad and you do not think there will be any tax to pay you should start with form IHT207.
Next of kin in Pennsylvania is your spouse, child or closest living relative. If you die without leaving behind a will, then Pennsylvania follows next of kin laws to distribute your estate.
The order of inheritance in Pennsylvania follows a specific hierarchy: Spouse and Descendants: If the deceased is survived by a spouse and children, the spouse typically receives the first $30,000 of the estate and half of the remaining assets. The children receive the other half.
