Use form FTB 3522, LLC Tax Voucher, to pay the annual limited liability company (LLC) tax of $800 for taxable year 2022. An LLC should use this voucher if any of the following apply: \u2022 The LLC has articles of organization accepted by the California Secretary of State (SOS).
Tax-Exempt Status. Aside from the above three exemptions, the only legitimate way to avoid paying the $800 franchise tax is to run a sole proprietorship, as they are not subject to the tax.
The Estimated Fee for LLCs only applies to LLCs that make $250,000 or more during a taxable year. This is filed on Form 3536 and is calculated based on your California LLC's gross receipts (total revenue). The larger the gross receipts, the higher the fee.
LLCs should use form FTB 3536, Estimated Fee for LLCs, to remit the estimated fee payment. A penalty will apply if the LLC's estimated fee payment is less than the fee owed for the taxable year. See Penalties and Interest, for more information. The LLC fee remains due and payable by the due date of the LLC's return.
Every LLC that is doing business or organized in California must pay an annual tax of $800. This yearly tax will be due, even if you are not conducting business, until you cancel your LLC. You have until the 15th day of the 4th month from the date you file with the SOS to pay your first-year annual tax.
