Q: What is the difference between Land Court and Regular System? A: Regular System serves to give notice that a document is on public record. Land Court System provides State certification for the ownership of a property. Property is in Land Court if it was registered with the State at some point since the 1900s.
The Land Court has exclusive original jurisdiction over all applications for the registration of title to land easements or rights in land held and possessed in fee simple within the State, with power to hear and determine all questions arising upon the applications.
The Regular System is a race-notice system. Basically any document for recording will be accepted by the Regular System regardless whether the parties have an interest in the subject land. In addition, a document with defects will still be accepted as long as it meets Hawaiis statutory requirements for recording.
Land Court This title contains the person the land is registered to, a description of the land, and a summary of any encumbrances. The application includes an accurate description of the land, survey maps and a complete abstract of title, which is reviewed by a title examiner and a surveyor.
Once we open a file, we usually have the documents drafted and sent out within 7 10 business days. Once we receive the properly executed documents, we normally record within 2 3 days and then distribute recorded copies within 2 3 business days.
