The Hazard Communication Standard (HCS), 29 CFR 1910.1200 (h), requires all employers to provide information and training to their employees about the hazardous chemicals to which they may be exposed at the time of their initial assignment and whenever a new hazard is introduced into their work area.
Any product that is considered a hazardous chemical requires a safety data sheet. A hazardous chemical, as defined by the Hazard Communication Standard (HCS), is any chemical which can cause a physical or a health hazard. This determination is made by the chemical manufacturer, as described in 29 CFR 1910.1200(d).
The required information consists of: Information on the likely routes of exposure (inhalation, ingestion, skin and eye contact). The SDS should indicate if the information is unknown. Description of the delayed, immediate, or chronic effects from short- and long-term exposure.
MIOSHA requires that copies of the SDSs for hazardous chemicals or products be readily accessible to employees at each work site and during each work shift. Federal law requires manufacturers and distributors of products containing hazardous substances to furnish customers with SDSs for each such substance or product.
OSHA standard, 29 CFR 1910.1020, Access to employee Exposure and Medical Records defines employee exposure records to include material safety data sheets. The standard requires all employee exposure records to be maintained for at least 30 years.
