Definition and Meaning

The Deprivation of Liberty Safeguards (DoLS) form 3 is a vital document used to assess whether an individual's liberty is being restricted for their own safety and well-being. It is a legal form in the United States that reviews and documents the justifications for depriving an individual, particularly those who are elderly or vulnerable, of their liberty in specific care settings. This process involves a detailed evaluation of the person's mental capacity, the necessity of the restrictions, and the person’s best interests. A completed DoLS form 3 ensures that the procedure complies with legal requirements, protecting both the individual involved and the care provider.

Steps to Complete the DoLS Form 3

  1. Evaluate the Individual's Capacity: Begin by assessing the individual’s ability to make informed decisions about their own care and accommodation. This step requires input from healthcare professionals and may involve cognitive testing to determine levels of understanding and decision-making capacity.

  2. Documentation of Best Interests: Collect and document information about what is considered to be in the best interest of the individual. This involves discussions with the individual's family, friends, and healthcare providers to ensure that any restrictions are implemented solely for the individual's benefit.

  3. Authorization Process: Address the need for authorization by submitting the form to the appropriate authority. Include all relevant information, such as medical assessments and personal interviews, to support the application.

  4. Final Review and Submission: Conduct a thorough review of the completed form for accuracy and completeness before submission. Once satisfied, submit the form through the established channels, whether online, by mail, or in person.

Key Elements of the DoLS Form 3

  • Person’s Details: Include the complete personal details of the individual whose liberty is potentially being restricted, such as name, age, and current living situation.
  • Mental Capacity Assessment: Provide a detailed account of the individual's mental capacity evaluation, highlighting any findings that justify the need for liberty deprivation.
  • Best Interest Analysis: Summarize the findings from discussions with family and professionals about what measures will serve the individual's best interests.
  • Signatures and Authorizations: Ensure that all necessary parties, such as family members and legal guardians, as well as healthcare providers, sign the document to validate the decisions made.

Who Typically Uses the DoLS Form 3

DoLS form 3 is commonly used by healthcare professionals, legal guardians, and social workers involved in the care and decision-making processes for individuals unable to make informed decisions due to cognitive impairments. It is particularly relevant in settings like nursing homes, hospitals, and assisted living facilities where restrictions may be necessary to ensure safety.

Importance of Using the DoLS Form 3

The primary value of utilizing a completed DoLS form 3 lies in its ability to provide a legal safeguard for individuals whose freedoms are restricted for their protection. By following the established procedures and completing the form accurately, care providers can ensure that their actions are legally compliant and ethically sound. It also serves as a comprehensive record that can be referenced in case of disputes or audits.

Legal Use of the DoLS Form 3

Legally, the use of the DoLS form 3 is governed by federal and state laws that protect the rights of individuals whose liberty is being considered for deprivation. Completing the form as required ensures that restrictions are justified and in the individual’s best interest, meeting legal obligations. Failure to properly complete and submit the form can result in legal complications and potential penalties for care providers.

State-Specific Rules for DoLS Form 3

While the overarching principles for the DoLS form 3 are consistent across the United States, specific requirements and processes can vary by state. Each state may have different bodies responsible for the review and approval of the form, and may require additional documentation or steps in the process. Understanding these variations is crucial for compliance.

Examples of Using the DoLS Form 3

Consider the case of Mr. Albert Gladstone Trotter, where the DoLS form 3 was employed to assess the necessity of liberty deprivation due to his vascular dementia diagnosis. This real-world example illustrates how the form is used to document mental capacity limitations, discussions around his best interests, and the authorization for restricted liberty to ensure his continued safety in a care facility like Green Acres Lodge. Such practical applications highlight the form’s role in the ethical management of care for vulnerable individuals.

There are 2 types of DoLS authorisations: urgent and standard.
There are two types of DoLS Authorisations - an urgent authorisation and a Standard Authorisation. When you apply for a Standard Authorisation, you can grant yourself a 7-day urgent authorisation if the person is already in your care home or hospital.
Ideally, the application should be made before you move. If this is not possible, an urgent authorisation may be needed (see section 4.3). If the supervisory body approves the new application for a standard authorisation, the previous standard authorisation automatically ends.
DOLS form 2 - Further authorisation request If the person is already subject to a current DOLS Authorisation, which is due to expire, you must complete DOLS form 2. Apply for a further authorisation request.
