54.041. LIEN. A landlord of a single or multifamily residence has a lien for unpaid rent that is due. The lien attaches to nonexempt property that is in the residence or that the tenant has stored in a storage room.
EXEMPT PROPERTY. The real property of the state, including the real property held in the name of state agencies and funds, and the real property of a political subdivision of the state are exempt from attachment, execution, and forced sale.
Section 92.104 of the Texas Property Code describes what a landlord may deduct from a security deposit: Before returning a security deposit, the landlord may deduct from the deposit damages and charges for which the tenant is legally liable under the lease or as a result of bdocHubing the lease.
If there is no response, Property Code Section 52.0012 provides that a judgment debtor may file a Homestead Affidavit as Release of Judgment Lien which serves as a release of record of a judgment lien established under this chapter. The affidavit must be in proper form, meeting all requirements of the statute.
