For any type of real estate title transfer, youll need to fill out the appropriate forms and have all parties sign in front of a notary. The new owner is responsible for filling out a Real Property Transfer Declaration form and recording the deed at both the recorders and county clerks offices.
General Property Transfer Affidavit Both parties must sign the affidavit, including all necessary information about the propertys location, value, and any outstanding debts or liens.
The term real estate or real property means the land plus anything growing on it, attached to it or erected on it, including man-made objects, such as buildings, structures, roads, sewers, and fences, but excluding anything that may be removed from the land without injury to the land.
It must be filed by the new owner with the Assessor for the City or Township where the property is located within 45 days of the transfer. If it is not filed timely, a penalty of $5.00 per day (maximum $200.00) applies. The information on this form is not confidential.
The form is used by the assessor to ensure the property is assessed appropriately and to make the proper transfer of ownership determination. The PTA must be filed by the buyer/grantee at the Assessing Department within 45 days of the transfer.
