Colorado is an arid, high elevation state, so staying hydrated is crucial for health. Although most of this liquid comes from beverages, food also provides water for us.
Water rights in Colorado are unique when compared to other parts of the United States. The use of water is governed by what is known as the Prior Appropriation System. This system of water allocation controls who uses how much water, the types of uses allowed, and when those waters can be used.
37-84-121. Any superintendent or any person having charge of said ditch who willfully neglects or refuses to deliver water, as provided in sections 37-84-118 to 37-84-123, or any person who prevents or interferes with the proper delivery of water to the persons having the right thereto commits a petty offense.
The water of every natural stream, not heretofore appropriated, within the state of Colorado, is hereby declared to be the property of the public, and the same is dedicated to the use of the people of the state, subject to appropriation as hereinafter provided. Section 6.
Under the Colorado Constitution, the water of every natural stream that is not claimed by a water right owner, called unappropriated water, is the property of the public and available for appropriation. Water rights are created by using water for a legally recognized use, such as irrigation.
