Withholding order is effective as soon as possible but no later than 10 days after it is received. Employer delivers papers to the employee -- a copy of the IWO, the attached statement of rights, and blank Request for Hearing within 7 days of receiving the IWO.
Courts take withholding child support by a parent especially seriously, and people who do so may be held in contempt of court, which will be further discussed later. As such, you cannot legally withhold child support unless your action to withhold child support is supported by a court order.
If child support remains unpaid for a year or the arrears exceed $5,000, the non-compliant parent may face felony charges. This can lead to up to four years in the Department of Corrections (DOC) and a $5,000 fine.
Because child support is so important, the law sets a very high limit on the amount that can be withheld from your paycheck for this purpose. If you are not currently supporting another child or spouse who are not the subject of the order, up to 60% of your wages can be garnished.
CCPA Limits: The limits provided in the CCPA are 50 percent of disposable earnings if the parent who pays child support has a second family and 60 percent if there is no second family.
