Understanding Child Support Laws in Oklahoma However, the failure to pay child support can become a felony offense under Title 21, Section 852 of the Oklahoma criminal code. This occurs when the total amount of past due child support exceeds $5,000 or when the individual goes without making any payments for a year.
Oklahoma law does not impose a statute of limitations on collecting unpaid child support that has been ordered by the court. This means that if a parent owes child support arrears, those arrears can be collected at any time, regardless of how many years have passed since they were initially due.
In Oklahoma, you must be separated for at least 90 days (if there are children) or 10 days (if there are no children) before a divorce can be granted.
If child support remains unpaid for a year or the arrears exceed $5,000, the non-compliant parent may face felony charges. This can lead to up to four years in the Department of Corrections (DOC) and a $5,000 fine.
State law and policy authorizes Child Support Services (CSS) staff to enter into a settlement waiving all or some of the child support arrearages assigned to the state of Oklahoma. See Appendix A. Settlements must be approved by the States Attorney and memorialized in a court order. This is referred to as the ARC.
