Colorado mechanics lien claims are documents recorded in the county recorder office. For your mechanics lien to be valid, you must record it in the county where the job is physically located. Every county has its own unique rules and requirements.
You need legal backing to place a lien on a business (or enforce it). That means you have to go to civil court and provide evidence that the business both owes you money (or other assets) and hasnt paid you back in full yet. The business will get a chance to dispute your case, and then the court will render a verdict.
In Colorado, a Notice of Intent to Lien must be served to the property owner at least 10 days before the lien is filed. The lien itself must be filed within two months of the last date of work or four months of the last date of work if the contractor supplied the materials for the project.
The lien release must be on the lienholders letterhead (letterhead is not required if lienholder is an individual). Copies and photos are accepted and must include vehicle year, make, VIN, titled owners name(s), agents signature, and date of lien release. Contact the state of record and request a lien release.
