Couples should be prepared to provide supporting documentation including account statements, appraisals, tax returns, etc. If either party undervalues, misrepresents, or omits financial information, it is very likely that the agreement will be rendered invalid or unenforceable.
In Massachusetts, an engaged couple can sign a prenuptial agreement to set out their respective property rights and obligations in the event of divorce or death. To be valid under Massachusetts law, a prenup must be reasonable and fair to both parties when it is signed and when it is enforced.
Prenuptial agreements are recognized under law in all 50 states and the District of Columbia. This widespread acceptance and recognition stems from the legal principle that marriage is fundamentally a contract between two parties.
While you can draft your own prenuptial agreement, it is strongly recommended to seek legal counsel to ensure that the agreement complies with Massachusetts law and that your rights and interests are adequately protected.
This means that, unlike many other states, Massachusetts does not automatically exclude pre-marital assets from the divisible marital estate. Property acquired before marriage can be ordered transferred to the other spouse upon divorce, even without a finding of contribution by the receiving spouse.

You can keep separate finances with or without a prenup. The prenup is an agreement to what happens if you divorce. If you DONT divorce it has no bearing on what you both agree to. So we have joint finances AND separate finances. The joint finance covers things like rates and taxes and maintenance etc.
While there is no specific timeframe in Massachusetts, at least one-week prior to I do is recommended. If an agreement is signed right before a wedding, courts may be suspicious that a party was pressured into signing so that the wedding would go through.
