Unlike traditional non-covenant marriages, a covenant marriage has limited legal grounds for divorce or legal separation but can be dissolved. Arizona is a no-fault state, and a non-covenant marriage only requires irreconcilable differences.
Your spouse has 30 days to respond. If they do not respond, you may apply for a default divorce on the 31st day. If you exhausted all the other options and paid to put an advertisement in an approved newspaper, the newspaper will give you a reciept of the notice. Your spouse has 60 days to respond.
Covenant and non-covenant marriages are the only two types of marital unions in the State of Arizona. However, covenant marriages were not legal in the state until they were codified by statute and became a law on August 21, 1998. A covenant marriage has more requirements before entering into the marriage.
This is any marriage in Arizona where the parties did not voluntary opt in to a covenant marriage. In other words, it is a marriage where the parties can seek a divorce for any reason. The fault provisions do not apply. Almost all marriages in Arizona are non-covenant marriages.
A dissolution is faster and may be less expensive than divorce. You can end your marriage in about 1 to 3 months after filing. However, if you and your spouse start to disagree about any of the terms after you file, you must start over with a new dissolution or divorce.
