The Revised Small Claims Procedure was developed by the Supreme Court to provide a simple, speedy, and inexpensive means of dispute settlement in courts. The procedure provides simple forms, dispute settlement procedures, and a one-hearing rule.
You can go to court and file a small claims case. You are not allowed to have a lawyer with you during the court proceedings. You will have to fill out a Statement of Claim Form.
A reading of the cited rule dictates that small claims cases are suits where the plaintiff merely claims or demands payment for money owed under a contract of lease, loan and other credit accommodations, services, or sale of personal property, where the amount does not exceed P1,000,000.
