The power of attorney is also widely used in many specific, limited transactions, such as real estate closings, allowing the agent to sign on behalf of the principal. On June 13, 2021, a new version of the New York Statutory Short Form Power of Attorney went into effect.

As of June 13, 2021, New York State enacted a new statutory Power of Attorney (POA) form. Any POA created prior to this date will remain effective if it conforms to the current law at the time of its execution. The newly reformed POA form enacted four major changes that are designed to simplify the prior POA form.
A New York Power of Attorney requires specific legal wording, notarization, and witnesses. The principal must be of sound mind and over 18 years old for a valid POA.
Most states provide blank POA forms for free, which the grantor can fill out and sign. Your grantor can also use free online software, like FreeWill, to create a durable financial power of attorney, or a living will (which includes a healthcare power of attorney).

With the new law, the Statutory Gifts Rider has been eliminated. Instead, it will now be included as a modification in the PoA. Even if the PoA document fails to include a gifts rider in the modifications, the agent can still make gifts up to $5,000 per year. (This is a major increase from $500 in the previous law.)
Is it advisable to avoid hiring an attorney and simply buy a POA form off the internet instead? As an attorney who has prepared POA forms for more than 25 years, my professional opinion is that, while some online forms are better than others, none of them is worth paying for.
