An Affidavit of Service (Form 16B) is a sworn or affirmed declaration describing the manner in which the documents were served on the another person.
General affidavits can be used to document a sworn statement of fact on any subject. These are unique from other types of affidavits because they can be tailored to meet specific needs in any legal situation.
How to write a general affidavit? Title your affidavit. Dont forget to list any relevant contact or identification information that you may need to include in the heading. Write your statement. Verify that your information is true. Finalize and docHub.
An affidavit is a sworn statement put in writing. When you use an affidavit, youre claiming that the information within the document is true and correct to the best of your knowledge. Like taking an oath in court, an affidavit is only valid when you make it voluntarily and without any coercion.
Your Affidavit of Service must be completed by the person who served the documents. The person who served the documents must swear the Affidavit of Service is true before a Commissioner for Oaths or Notary Public. The Affidavit of Service will: explain who delivered the documents.
In Canada, there are certain requirements that must be met in order for an affidavit to be considered valid. These requirements include: The affidavit must be in writing and signed by the person making the statement (the affiant). The affiant must swear or affirm that the contents of the affidavit are true and correct.
The name of the person who served the document (e.g. you or a representative or friend) and where they are from; The name of the person who was served; When the document was served (day, month and year);where the document was served (e.g. house number, apartment number, street name, city, and province);
A notary public has all the powers of a commissioner for taking affidavits and, can verify that signatures, marks and copies of documents are true or genuine. Notaries are regulated under the Notaries Act . Every lawyer and paralegal in Ontario is also automatically a commissioner for taking affidavits.
