Since 1994, federal law has required such diesel fuel to be dyed bright red to signify its taxability status. Using dyed diesel on the highway, or knowingly selling it for such use, is illegal under both Texas and federal law.
Texas imposes a 6.25 percent state sales and use tax on all retail sales, leases and rentals of most goods, as well as taxable services.
For example, flour, sugar, bread, milk, eggs, fruits, vegetables and similar groceries (food products) are not subject to Texas sales and use tax. Tax is due, however, on non-food items such as paper, pet, beauty and hygiene products; clothing; books; and certain edible items.
Fuel Surcharges A fuel surcharge may be subject to Texas sales and use tax. Fuel surcharges are taxed or exempted in the same manner as charges for transportation or delivery.
The state of Texas levies a flat 20 cent per gallon tax on gasoline and diesel fuels. Of these 20 cents, 15 cents is dedicated by the Texas Constitution to roadways, with the remaining 5 cents dedicated to public education. The tax is included in the price of fuel you buy at the pump.
