RULE 37 HOW TO HAVE A SUBPOENA ISSUED Any party to proceedings before the CCMA may request the CCMA to issue a subpoena for a witness to appear before the CCMA by completing LRA Form 7.16 together with a written motivation.
This form enables a person or organisation to refer a dispute to the CCMA for conciliation and con-arb. WHO FILLS IN THIS FORM? Employer, employee, trade union or employers organisation.
A 7.13 is a request for arbitration form completed in ance with Section 136 of the Labour Relations Act (LRA). If a matter remains unresolved at Conciliation, the Commissioner will issue a certificate of non-resolution in ance with Section 135(5) of the LRA to the parties.
Section 143(1) of the LRA says an arbitration award is final and binding.
WHERE DOES THIS FORM GO? The Registrar, Regional Office of the CCMA in the region where the dispute arose. Please note that if you are covered by a bargaining council, a statutory council or an accredited agency you have to refer the dispute to the relevant council or agency.
