Who Can Fill Out an FMLA Form? The forms for FMLA leave vary ing to whether the employee needs the leave for themselves or to care for family members. The forms must be filled out in the appropriate sections by the employer, employee, and healthcare provider.
The FMLA does not require the use of any specific certification form. The Department has developed optional forms that can be used for leave for an employees own serious health condition (WH-380-E) or to care for a family members serious health condition (WH-380-F).
The employer should provide the required notices to the employee seeking leave. Completed certification forms should be given to the employee to provide to the employer, as it is the employees responsibility to provide the employer with the completed certification.
A doctor of medicine or osteopathy who is authorized to practice medicine or surgery (as appropriate) by the State in which the doctor practices; or. Any other person determined by the Secretary to be capable of providing health care services.
Employees should declare their need for leave at least 30 days in advance, unless the need is unforeseen. The WH-381 form is the form filled out by an employer that provides employees with important information related to their leave request.
