For the 2024 tax year, the Oregon estate tax rates range from 10% to 16%, depending on the value of the estate. The tax is calculated on the portion of the estate that exceeds the $1 million exemption threshold[ii].
The executor of a decedents estate uses Form OR-706-EXT to apply for extensions of time to file Form OR-706 and/or pay the estate tax due. Both requests may be made on a single form. This form is required for estates of decedents dying on or after October 1, 2023.
If the gross estate of an Oregon resident has a value of more than $1 million, the personal representative or executor of the estate must file a state estate tax return. (Smaller estates wont need to file a return.)
Estates with gross values (total estate value both inside and outside of Oregon) greater than or equal to $1 million are required to file estate tax returns while estates valued less than $1 million are not subject to the tax and no return is required.
