This form is used by NSW LRS to notify the local council, water supply authority and relevant rating authorities of changes in ownership of the properties. Legislation requires this form to be lodged in all cases where the registered proprietor name on title changes, including a change of name.
The land register will require that you complete Transfer Form 01T and Form 10-0520. The transfer form is downloadable online. Filling this form allows the government to record the recipients legal interests on the lands title. In NSW, the purchaser or recipient of the property must complete the ODA 076 form.
A transfer by direction, ie. intervening parties between the transferor and the transferee, must state the full name of the transferee. The full names of the intervening parties may also be shown either on an annexure or at Note (C). See Baalman And Wells, Land Titles Office Practice, Lawbook Co. 2001 [549.500].
In California, for example, the notice of sale must be sent 21 days before the sale and include the time, location, and date of the sale, as well as the property address, the foreclosure trustees name, address, and phone number. Foreclosure auctions and trustee sales are required to be held in a public place.
