(1946) The Administrative Procedure Act (APA) governs the process by which federal agencies develop and issue regulations. It includes requirements for publishing notices of proposed and final rulemaking in the Federal Register, and provides opportunities for the public to comment on notices of proposed rulemaking.
Legislation is enacted by the Florida Legislature, published in the Laws of Florida, and codified in the Florida Statutes. State agencies publish regulations (sometimes called administrative law) in the Florida Administrative Register (FAR), which are in turn codified in the Florida Administrative Code (FAC).
Pursuant to Rule 12A-1.096(6), F.A.C., before the owner of the qualifying new or expanding business may request a refund, it is necessary to obtain certified statements from the vendors, contractors, and subcontractors who supplied or provided the qualifying machinery and equipment and paid the sales tax to the State
(d) Except as otherwise provided by statute, the proponent of a rule or order has the burden of proof. Any oral or documentary evidence may be received, but the agency as a matter of policy shall provide for the exclusion of irrelevant, immaterial, or unduly repetitious evidence.
In Chapter 120, Florida Statutes, the Administrative Procedure Act outlines a comprehensive administrative process by which agencies exercise the authority granted by the Legislature while offering opportunities for citizen involvement.
