Motions without consent. If you have a final order from a judge or an Agreement for Support Filed under s. 35 of the Family Law Act, and you would like to change it because your circumstances have changed but the other party does not agree with the change, you need to request a motion to change.
There is no specific age such as 12 or 14 when children get to decide who they will live with. Each child is unique, and their views are one factor that a judge will consider when deciding what parenting arrangement is in their best interests.
If you do not agree to the changes that the other party is requesting, you need to complete: Form 15B: Response to Motion to Change to you explain why you do not agree with the changes that the other party wants and ask the court to make different changes to your current arrangement.
A party can ask for an Emergency Order in very limited situations such as an immediate risk to the client and/or the children or an immediate danger that the other party will take the children out of the country and not return them. Emergency Motions can only take place within a Family Court Case.
