Disclosures that need not be tracked include: Disclosures covered by a HIPAA authorization form that the person or his or her personal representative has signed, Disclosures of PHI in the form of a limited data set; Disclosures made to the subject of the PHI; and.
The HIPAA Privacy Rule governs the use and disclosure of PHI by covered entities, which include healthcare clearinghouses, health insurers, employer-sponsored healthcare plans, and medical providers.
A covered entity must obtain the individuals written authorization for any use or disclosure of protected health information that is not for treatment, payment or health care operations or otherwise permitted or required by the Privacy Rule.
