Under current Virginia law, the court will only seal your criminal records if: (1) you were acquitted; (2) the government decided not to prosecute you; (3) the charges against you were dismissed without evidence sufficient for a finding of guilty; or (4) the crime was committed by someone using your identity.
To have your record expunged, a petition must be filed in the Circuit Court of the jurisdiction where you were originally charged. You will need to be fingerprinted, and there is a waiting period. During that waiting period, the Commonwealths Attorney receives a copy of the petition, and has an opportunity to object.
The fee for an expungement is $103.00 ($86.00 for filing the Petition, $5.00 paper submission fee and $12.00 for service by the Sheriff on the Commonwealths Attorney). Payment may be made by cash, check or money order made payable to the Clerk of the Circuit Court; or by credit card (Visa, MasterCard or Discover).
Under Virginias current expungement law, even with the help of a lawyer, expunging a criminal record often takes at least nine months, and sometimes much longer. Because the new law includes automatic sealing, some records will be sealed on a monthly basis, as soon as they become eligible.
You may always file the case without an attorney (pro se). Your circuit court may be able to provide you with the necessary forms for filing your petition; however the courts are not allowed to give you any legal advice about your case.

Most people can file and successfully process their own Texas expungement forms without the assistance of a lawyer. All you need is the proper forms and easy step-by-step instructions to complete your Texas expungement.
If the court grants the expungement, this charge will not appear when someone runs a background check on you. Conversely, if the charge is dismissed and you dont get an expungement, the charge will appear on your record but it will show that the charge was dismissed.
The applicant must complete a Petition for Dismissal form for each case separately and submit it to the Superior Court where the conviction occurred for review and decision by the court. Any supporting documents to show why the court should grant the dismissal/expungement must be filed with the Petition.
