Bald eagles are very territorial birds, and most breeding pairs return to the same nest site year after year. They may use the same nest annually for as many as 35 years, or they may build additional nests in their nesting territory, and alternate the use of them from year to year.
Human activities that cause disturbance to eagles or their nest or lead to injury, a decrease in productivity, or nest abandonment are a violation of the federal Bald and Golden Eagle Proection Act.
Eagles will often return to the same nest year after year if it is successful. The nest is commonly 6-8 feet across and added onto each year. Eagles lay 1-3 eggs beginning as early as January. Parents take turns incubating the eggs which hatch in about 35 days.
If a landowner is going to do anything in an area that may cause disturbance to an eagle nest, they should consult the Fish and Wildlife Service. Nests are built in tall, large diameter trees near waterways. Nests are 6 to 8 feet wide and are often reused and added on to each year. Nests can weigh up to 2,000 pounds.
A Federal permit for take of an eagle nest authorizes take (removal, destruction and/or relocation) of a bald eagle or golden eagle nest in limited circumstances.
