The Patent Prosecution Highway (PPH) allows you to speed up the examination of your patent application. It can be used if your patent application has a corresponding patent application that is already deemed to be allowable by one of our PPH partners.
How does the PPH work?
Under PPH, participating patent offices have agreed that when an applicant receives a ruling from a first patent office that at least one claim is allowable, the applicant may request fast track examination of corresponding claim(s) in a corresponding patent application that is pending in a second patent office.
What is the PPH patent application?
The Patent Prosecution Highway (PPH) is a programme to fast-track patent examination. It allows you to request accelerated processing of a European application if the claims have been deemed patentable/allowable by another office. At the same time, it enables the EPO to re-use the work done at other offices.
When can you request PPH?
You can file your PPH request at any time before the substantive examination has begun.
What is the primary purpose of patent prosecution?
It ensures that the patent remains enforceable and continues to provide value to the patent holder. Patent prosecution is distinct from patent litigation, which describes legal action relating to the infringement of patents.
