TTD benefits are paid at the rate of 66 ⅔% of your average weekly wage pre-injury (subject to the state maximum). Benefits start on the 8th day of the disability (unless the disability lasts only 14 days, in which case the benefits will be back-paid to the first day of disability).
The benefit is 66 and 2/3 percent of the employees pre-injury average weekly wages and cannot be less than the minimum, or more than the maximum, weekly benefit. It is payable until the employee docHubes maximum medical improvement or returns to work or for a period of 450 weeks, whichever is shorter.
Once you have the estimated annual payroll for the employee, divide that number by 100. You then multiply that number by the premium rate for the class code to find the total cost of workers compensation insurance for that employee.
Submit a statement of the employees wages to their workers compensation insurance adjuster on a Wage Statement (Form C-41). The wage statement should show the gross wages earned by the injured employee, including overtime, bonuses, etc., each week for the fifty-two (52) weeks prior to the injury.
The weekly maximum compensation rate for a Permanent Total Disability and a Permanent Partial Disability is $752.00 (100% of average wages in Tennessee). In Tennessee, an injured employee can only receive workers compensation disabilty payments for a maximum of 400 weeks.
