A code compliance certificate is issued by the Council under Section 95 of the Building Act 2004 when all the requirements of Section 94 of the Building Act 2004 have been met. This includes being satisfied on reasonable grounds that the building work complies with the building consent.
Code compliance refers to following laws, rules, and guidelines that make sure buildings and structures are safe and built properly. It means that each part of a construction project meets local, state, and national building codes.
Typically, manufacturers issue Certificates of Compliance, but accredited third-party test laboratories can also grant them. The standards for issuing a CoC can be voluntary, set by trade associations, or mandatory, dictated by government bodies. A CoC usually lists the products standards and its country of origin.
Once you and your solicitor have complied with the requirements, the landlord or managing agent should issue the certificate of compliance which your solicitor can produce to the land registry. The registry will then remove the restriction on the title so that you can be registered as the proprietor.
A Certificate of Compliance is the tool used by the County to inform title companies, lenders, and the general public that such parcels comply with state and local subdivision laws.
