To ask the judge to set aside (cancel) the default judgment or other order against you, you will have to ask for a court hearing. To ask for a court hearing, complete paperwork and file specific forms with the court (see below for how to complete your request).
In California state criminal procedure, a motion to dismiss pursuant to Penal Code Section 995 gives the defendant the option of moving a trial court to dismiss their criminal case following a preliminary hearing at which the defendant was held to answer on one or more criminal charges.
Consent from the claimant is very likely to lead to the judgment being set aside but its not guaranteed. Consent on its own is not enough. It is always at the discretion of the court. Our experience is that judges are generally happy to endorse an agreement made between the parties to litigation.
Use the form called Notice of Motion to Vacate Judgment and Declaration (SC -135) to say why you did not go to the hearing. You have to pay a filing fee. If you are unable to pay the filing fee, you may apply to the court to have the fees waived. File your documents at the court where the case was filed.
The court must set aside a default judgment if you: have paid the whole amount owed (including any interest and costs) before the date the creditor entered judgment; sent back the acknowledgment of service form within the time limit; put in a defence within the time limit; or.

Discretionary grounds the court may set aside default judgment in circumstances where (i) the defendant has a real prospect of successfully defending the claim and/ or (ii) there is some other good reason why the defendant should be allowed to defend the claim.
To ask a court to set aside (cancel) a court order or judgment, you have to file a request for order to set aside, sometimes called a motion to set aside or motion to vacate. The terms set aside or vacate a court order basically mean to cancel or undo that order to start over on a particular issue.
Take your completed Form SC-150 or letter to the clerks office. Ask the clerk to attach it to your file. Or go to your trial and ask the judge for a postponement (or continuance). In your Form SC-150 or letter, give the judge a good reason why you are filing your request late.
What is a set aside application? A defendant who has a default judgment against them can apply to the court that issued the judgment to set it aside. If the court sets aside the judgment, it is as though the order was never made. The court still needs to deal with the claim.
You must file the request for order to set aside within 2 years after the date when the default judgment was entered against you. The deadline is sooner if the court files show that you were served with a written notice of entry of that default judgment.
