A durable power of attorney permits an agent to make decisions even if the princi- pal becomes incapacitated. Powers of attorney signed after January 1, 2010, are durable unless the document provides that it is terminated by the incapacity of the principal.
Unless you specify otherwise, generally the agents authority will continue until you die or revoke the power of attorney or the agent resigns or is unable to act for you. Your agent is entitled to reasonable compensation unless you state otherwise in the special instructions.
Verbal revocation: As long as you are of sound mind, you can revoke someones POA privileges simply by telling them out loud and in front of witnesses that you no longer wish for them to retain power of attorney privileges over your property and/or affairs. Its that simple.
Does a Power of Attorney need to be notarized? In Colorado, the law does require that a Financial Power of Attorney be notarized, but no witnesses are necessary. A medical Power of Attorney need not have witnesses or be notarized.
The principal revoking the power of attorney must inform the original agent, their financial institutions, and relevant medical providers that they are revoking the original document in order for the revocation to be effective.

When someone makes you the agent in their power of attorney, you cannot: Write a will for them, nor can you edit their current will. Take money directly from their bank accounts. Make decisions after the person you are representing dies. Give away your role as agent in the power of attorney.
The POA cannot transfer the responsibility to another Agent at any time. The POA cannot make any legal or financial decisions after the death of the Principal, at which point the Executor of the Estate would take over. The POA cannot distribute inheritances or transfer assets after the death of the Principal.
Choosing between durable and general depends on what you need for the future. We suggest talking to an estate planning lawyer to see which one is right for you. In short, durable powers of attorney give better protection if someone cant make decisions and keep decision-making going.
