In California, you have 30 days to respond to an interrogatory. If you do not respond within this time, the opposing side can file a motion to compel with the court. The court may require them to first consult with you about your failure to respond before officially filing a motion to compel.
Parties may object to these pattern interrogatories on grounds including, but not limited to, that the interrogatories exceed the scope of permissible discovery as defined in C.R.C.P. 26(b)(1) because the inquiry is not relevant to the claims and defenses of any party or is not proportional to the needs of the case.
The fact that you think the other side wants your former spouse and not you is irrelevant. The only way you could safely NOT answer the interrogatories is if you convince the other side to formally withdraw them. Bottom line: take the time to respond to the interrogatories.
The deadline for completion of all discovery, including discovery responses, shall be not later than 49 days before the trial date.
Answer all of the questions and each and every part thereof fully and completely. Your answers must be filed with the Court and a copy mailed to the sender no later than 14 days after you receive these Pattern Interrogatories. Use a separate sheet of paper, if necessary.
