Federal Law states that all breaks lasting under 20 minutes are considered part of the workday and must be paid. Meal breaks lasting 30 minutes or longer can be unpaid, so long as employees dont work during that time. Employees must receive a paid 10-minute break for every 4 hours of work.
However, ing to the U.S. Department of Labor, federal law says that if a company chooses to allow break periods, any break under 20 minutes should be paid, and any over 30 minutes can be unpaid and classified as off-the-clock.
California requires employers to provide employees with ten-minute rest breaks for every four hours (or major fraction) worked. Anything over two hours is a major fraction of a four-hour period.
Elementary schools and schools with grades one through eight, inclusive, must provide a minimum of 200 PE instructional minutes to pupils each 10 school days excluding recesses and lunch time.
Under California law, non-exempt employees are entitled to one unpaid 30-minute meal break, and two paid 10-minute rest breaks, during a typical 8-hour shift. Employees must receive their off-duty meal breaks before the end of the fifth hour of work.
