After a federal court enters a judgment, a litigant has 28 days to file a motion to amend the judgment pursuant to Federal Rule of Civil Procedure 59(e). This rule allows a district court to correct its own errors and spare the parties and appellate courts the burden of unnecessary appeal.
On a motion for a new trial in an action tried without a jury, the court may open the judgment if one has been entered, take additional testimony, amend findings of fact and conclusions of law or make new findings and conclusions, and direct the entry of a new judgment.
The judgment sought shall be rendered forthwith if the pleadings,depositions, answers to interrogatories and admissions on file, together with the affidavits, ifany, show that there is no genuine issue as to any material fact and that the moving party isentitled to a judgment as a matter of law.
