Pursuant to KSA 58-2565, if a tenant abandons household goods, furnishings, fixtures or any other personal property in or at the dwelling unit, the Landlord must take possession of the property and store it at the tenants expense.
Example: In California, under Civil Code Section 1951.3, abandonment is presumed if the tenant has not paid rent for at least 14 consecutive days and there is reason to believe the tenant has deserted the rental unit.
Sample Legal Notice of a Vacate Letter Dear [Tenants Name], This letter serves as formal notice that you are required to vacate the premises at [Rental Property Address] by [Date]. This notice is being given in accordance with the terms of your lease agreement, which expires on [Lease End Date].
If, after the tenant is 10 days in default for nonpayment of rent and has removed a substantial portion of such tenants belongings from the dwelling unit, the landlord may assume that the tenant has abandoned the dwelling unit, unless the tenant has notified the landlord to the contrary.
At minimum, it should include the following: Todays date. The landlord and tenants names and contact information. The address of the rental property. An introduction explaining the landlords reasons for believing that the unit has been abandoned. The last date that rent was paid and the amount currently overdue.
