Hawaii law provides that unless an extension is granted, every judgment and decree of any court of the State shall be presumed to be paid and discharged at the expiration of ten years after the judgment or decree was rendered.
Section 14 of CPC states that an Indian court will presume a foreign judgment to be valid unless proven otherwise. However, this presumption can be challenged if the judgment violates Indian law. A party can present evidence in court to prove that the foreign judgment is not legally binding under Indian law.
Under U.S. law, an individual seeking to enforce a foreign judgment, decree or order in this country must file suit before a competent court.
Six years from the date of the judgment. The time limit for making an application for the registration of a Mainland judgment is two years from the date of the judgment taking effect or, where a period for performance has been specified in the judgment, from the last day of that period.
The only U.S. states which have not adopted the Uniform Enforcement of Foreign Judgments Act are California and Vermont.
