The 2006 revised act expanded the list of persons who can consent to organ donation on behalf of an individual, gave every individual the opportunity to donate their organs at or near death, and stated that individuals who refuse to donate must explicitly state so.
The Act sets a regulatory framework for the donation of organs, tissues, and other human body parts in the US. The UAGA helps regulate body donations to science, medicine, and education. The Act has been consulted in discussions about abortion, fetal tissue transplants, and Body Worlds, an anatomy exhibition.
Every state has enacted the provisions of the act in some form. The act allows a decedent or surviving relatives to donate certain parts of the decedents organs for certain purposes, such as giving to those in need or for medical research. The act was revised in 1987 and again in 2006.
The UAGA establishes the legal framework governing anatomical gifts in the United States. It ensures: A persons decision to register as a donor is legally binding. Next of kin cannot override that decision once it is made.
To address the nations critical organ donation shortage and improve the organ matching and placement process, the U.S. Congress passed the National Organ Transplant Act (NOTA; P.L. 98-507) in 1984.
