When you are offered a deferred prosecution agreement or DPA, you will often be required to enter a guilty plea to the offense you are charged with. The Court will defer the entry of a judgment of conviction against you, and therefore you will not be convicted.
The overarching mission of deferred prosecution programs is to provide individuals with the opportunity to accept responsibility for their actions, engage in behavioral health treatment and human service programs (when needed), and reduce the probability of future criminal offending behavior.
Under a DPA, the government will bring charges against a defendant but agrees not to move forward on those charges. In exchange, the defendant agrees to abide by certain requirements or conditions. If the defendant satisfies its end of the bargain, the government agrees to drop the charges.
If the charge was a misdemeanor, then, one year from the date that the deferred sentence ends, you are eligible for a full expungement. If charged with a felony, you are eligible for a full expungement five years from the end of a deferred sentence.
