You should contact a lawyer as soon as you receive the Notice to Quit. Summons and Complaint: If you decide to remain in the rental and fight the eviction, the Summons and Complaint is the next document you will receive, also delivered by a Marshal. This document has a box marked RETURN DATE.
The Notice to Quit must allow the tenant at least three full days to move. This means that there must be three full days between the date the Notice to Quit is served and the last day listed in the Notice to Quit to vacate the premises.
To start a court case, you landlord will instruct a marshal to deliver a court summons and complaint to your apartment sometime after the date on the notice to quit. Keep an eye out for these papers. After you receive the court summons and complaint, you must quickly respond by submitting paperwork to the court.
