Severance pay A terminated employee may be entitled to more than the minimum amount of termination notice or pay required under employment standards legislation. This is often referred to as severance pay. Severance pay is determined under common law and not required under the Employment Standards Code.
Severance pay is not required under any law or statute in Washington, however, it can be a term in an initial employment contract. It can also be part of a collective bargaining agreement.
A severance or exit package is a bundle of benefits offered to employees who are laid off, terminated, or, under specific circumstances, voluntarily leave their jobs.
There is no set amount to which you are entitled as severance pay according to the Fair Labor Standards Act (FLSA). It is often based upon length of employment, but there are no true guidelines for how much a terminated employee is entitled to receive.
While theres no federally mandated amount, a common rule of thumb is one to two weeks of pay for every year of service. For example, if youve been with a company for 10 years, you might expect between 10 and 20 weeks of severance pay.
