A Motion is the name of a paper that you must file to ask a judge to make a ruling or to take some other action for you once you have started a lawsuit. A Motion does not start a lawsuit.
A motion is an application to the court made by the prosecutor or defense attorney, requesting that the court make a decision on a certain issue before the trial begins. The motion can affect the trial, courtroom, defendants, evidence, or testimony.
If you want to file a motion, the process is generally something like this: You write your motion. You file your motion with the court clerk. The court clerk inserts the date and time your motion will be heard by the judge. You serve (mail) your motion to the other side.
You, or your attorney on your behalf, will file a Notice of Motion which includes a list of requests for the court to rule upon. You will also submit a Certification listing the reasons you are making these requests of the Court and why the Judge should grant your relief, effectively your testimony.
A motion is simply a request to the court for some action. An example is a motion for an extension of time to file something.
