Codicils and Their Role in Overriding an Old Will. A codicil is a legal tool that allows modifications to an existing will without drafting a new one. In the context of overriding or updating an old will, a codicil can introduce changes while leaving the rest of the original will intact.
It is therefore well settled that a codicil, so long as it is executed with the applicable statutory requirements, can effectively revive or validate a will which has been revoked or is otherwise invalid, so long as the revoked or invalid will is still in existence.
We define a codicil as a legal document that is used to modify an existing will without completely replacing it. This document allows you to make minor changes to your will, such as adding or removing beneficiaries, changing the personal representative, or updating asset distributions.
A no-contest clause usually states that a beneficiary will lose anything they were to inherit upon a persons death should they try to contest the will. For a no-contest clause to work, the beneficiaries must be inheriting something of value from the will or there will be no motivation not to go to court.
