There are two steps involved in appealing to the RAD : Filing your appeal. You must file your notice of appeal to the RAD no later than 15 days after the day on which you received the written reasons for the RPD decision. Perfecting your appeal.
THE REFUGEE APPEAL DIVISION Decisions on most appeals are expected within 90 days unless an oral hearing is required. However, over the past year these timelines have been extended to over one year. Failed claimants before the RAD can still ask the Federal Court to review a negative decision.
To perfect an appeal, the person who is the subject of the appeal must provide two copies (one copy if electronic) of the appellants record to the RAD. If the Minister is the appellant, they must provide the RAD with any supporting documents and may provide an appellants record.
Appeal submissions will be reviewed in the order in which they are received. Generally, the Appeal Division renders its decision within four (4) months.
This includes communications indicating an intention to file the appellants record after the expiry of the 45-day time limit for perfecting the appeal. If the time limit cannot be met, an application requesting an extension of time must be submitted to the RAD before the expiry of the time limit or without delay.
