In modern times, though, a devisee usually refers to anyone who receives property by being named in a decedents will whether they are related or notlike a friend, as described above.
(a) Devisee means any person designated in a will to receive a devise. (b) In the case of a devise to an existing trust or trustee, or to a trustee on trust described by will, the trust or trustee is the devisee and the beneficiaries are not devisees.
A devise is the act of giving real property by will, traditionally referring to real property. A bequest is the act of giving property by will, usually referring to personal property. Today, the two words are often used interchangeably due to their combination in many wills as devise and bequeath, a legal doublet.
