The conservator, by assuming the responsibility for these matters, becomes legally accountable to the court. There are two types of conservatorship managed by the Public Guardian: Lanterman-Petris Short (LPS) Conservatorships and Probate Conservatorships.
The Probate Court follows S.C. Code Ann 62-5-410 to determine who has the authority to serve as the Conservator. A summons and a petition (540PC) must be completed and filed with the court to begin the process of appointing a Conservator. An initial filing fee of $150.00 must also be paid.
In California, the determination of legal incompetence or incapacity is typically made through a legal process. The court takes into account evidence of impaired judgment, cognitive decline, or other indicators of incapacity. This requires medical and/or psychological evaluations from professionals.
A third person (not the proposed conservator) must personally serve written notice of the proposed conservatorship on the conservatee. This notice consists of a citation and a copy of the petition for conservatorship. Family members of the conservatee must also be notified.
Under South Carolina law, if an adult cannot understand their medical needs and cannot make reasonable medical decisions, the Probate Court can determine that they are incapacitated and can appoint someone else to act as that persons Guardian.
