The fifteen-year requirement for adverse possession is mandated by Minnesota Statute 541.02, which addresses the recovery of real estate.
In order to claim title under Minnesotas adverse possession law (Recovery of Real Estate), you must be in possession of the property for 15 years and pay taxes for at least five consecutive years. The statute excludes certain boundary line disputes (see FindLaws Property Boundaries section to learn more).
A quiet title action can be used when possession needs to be recovered of a property that has been wrongfully occupied by another individual. A plaintiff, buyer, or new homeowner can choose to file an action to include any present or past owner of the property who may have a claim to it.
Time Requirements: 15 Years of Continuous Occupancy: Under Minnesota law (Minn. Stat. 541.02), a squatter must occupy the property continuously for at least 15 years to claim adverse possession. This time frame must be uninterrupted; any break in occupancy could reset the clock.
Heart disease and cancer have been the two leading causes of death since 1999. For every 100,000 people living in Minnesota, 161 people died from heart disease and 180 died from cancer in 2022.
