Named after the court case that gave rise to the rule, a Crummey Notice is simply a letter letting a beneficiary know that assets have been added to a trust and informing the beneficiary of his/her right to withdraw those assets if applicable.
To alert the beneficiaries that the trust creator has made a gift and that they have a short time to withdraw part if they wish, the trustee sends beneficiaries a Crummey notice. It is named after a legal case about withdrawal rights.
For example, if you set up a Crummey trust for your daughter and the trust generates $5,000 of income in a given year, you would be able to gift $19,000 to the trust that year and also pay the taxes on the $5,000 of income.
Crummey Notices Are Not Required: The U.S. Tax Court in Turner, Tax Court Memo 2011-209, found that such a notice by the trustee is not required. In that case the decedent created a trust during his life to own life insurance policies on his life for the benefit of his children and grandchildren.
