Form 8843 is not a U.S. income tax return. It is an informational statement required by the IRS for nonresidents for tax purposes. It should be submitted for every nonresident tax payer present in the U.S. at any point during the previous calendar year, including spouses, partners, and children.
If you are an alien individual, file Form 8843 to explain the basis of your claim that you can exclude days present in the United States for purposes of the substantial presence test because you: Were an exempt individual. Were unable to leave the United States because of a medical condition or medical problem.
All F-1/J-1 foreign national (and their F-2/J-2 dependents) who are non-residents for tax purposes are required to file Form 8843. This is the case whether or not you received income or are filing a separate tax return.
U.S. citizens or resident aliens are considered exempt from backup withholding if their reported name and Social Security Number matches the IRS records. Additionally, you are exempt if you have not been notified by the IRS that you are subject to mandatory backup withholding.
